– Salario minimo – Aggiornamenti -
Comunicazione IRU dell’11.9.2015.
La
vicenda del salario minimo garantito
(pari a 8,50 euro l’ora) introdotto in Germania dall’1 gennaio 2015 per tutte
le imprese (tedesche e non) si arricchisce di una nuova puntata. In attesa
degli sviluppi della procedura di infrazione aperta prima dell’estate dalla
Commissione europea le autorità tedesche, dopo aver già sospeso le disposizioni
sul salario minimo per i trasporti in transito nel territorio tedesco, hanno ora
parzialmente esentato le imprese che effettuano cabotaggio e trasporto
internazionale da e per la Germania dagli obblighi amministrativi conseguenti
al salario minimo garantito (quali notifica e registrazione di dati in merito
all’impresa, all’autista e al trasporto). In particolare come riportato dall’IRU (International
Road Transport Union) l’esenzione scatta in
presenza di almeno una delle seguenti condizioni:

la retribuzione media mensile dell’autista deve
essere superiore a 2.958 euro lordi;
·
la retribuzione mensile dell’autista può essere
anche inferiore a 2.958 euro purché negli ultimi 12 mesi sia stata superiore a
2.000 euro lordi;
·
l’autista oltre che dipendente
è anche parente stretto del datore di lavoro (coniuge, convivente, figlio o
genitore).
La
documentazione (in lingua tedesca) attestante le predette condizioni deve
essere esibita alle autorità tedesche in caso di controlli.
L’IRU segnala inoltre come permanga ancora incertezza sulla
nozione di retribuzione da considerare per il calcolo del salario minimo in
particolare per quanto riguarda la computabilità degli elementi accessori
(quali le maggiorazioni ed i supplementi); ulteriori informazioni in merito
sono riportate sul sito delle dogane tedesche (www.zoll.de).

GERMAN MINIMUM WAGE –
CHANGES TO THE NOTIFICATION PROCEDURE (LOWERED THRESHOLD FOR THE EMPLOYEE
INCOME)
Dear Members,
this is to inform you that the German authorities
have lowered the thresholds for the various obligations under MiLoG. As of August 2015, the employer's notification,
recording and documentation requirements according to MiLoG
are not required if the following conditions are met:
1. The employee's sustained
regular pay exceeds a threshold of a gross
2'958 EUR per month, or
2. The employee's sustained
regular pay exceeds a threshold of a gross 2'000 EUR per months and
the employer can prove that he paid this monthly pay during the last 12 months,
or
3. The employer is
employing by labour contract a close relative (employer's spouse,
registered life partner, child, parents).
Please note that it is still not clear, despite
the ongoing IRU requests, what elements (i. e. allowances) can be taken into account when
calculating the minimum wage. According to the interpretation of the German
authorities (see here, scroll down to allowances and supplements)
allowance as the widely understood concept of “the reimbursement of expenses actually incurred by
the worker in the framework of the employment relationship as a consequence of
an employer’s instruction” cannot be taken into account when calculating
the minimum wage.
